In an interesting series of postings from a variety of blawgers, the blawgosphere looks at the Commonwealth of Kentucky's Attorneys' Advertising Commission and how it intends to treat blawgs authored by lawyers under Kentucky's lawyer advertising regulations. More specifically, if the Commission decides to treat a blawg as advertising, a host of requirements, including a $50 "filling fee" per blawg post could be applied to any Kentucky lawyer who maintains a blawg.
The blawg at the center of the discussion is Kentucky lawyer Ben Cowgill's Legal Ethic's Blog. Others offering thoughts on the issue include Ernest Svenson, David Giacalone and Dennis Kennedy. To its credit, the Advertising Commission has given a "green light" to Mr. Cowgill to continue posting to his blawg without fee while it evaluates blawgs and how they should be defined in relation to the advertising rules. Mr. Cowgill also deserves much credit for bringing the matter up now so that it can be evaluated and resolved before large numbers of Kentucky lawyers start to blawg.
